1. Acceptance of Terms

By accessing or using 43frames ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, or violates any third-party rights
• Create deepfakes or misleading content intended to deceive
• Infringe on intellectual property rights of others
• Upload images you do not have the right to use or distribute
• Engage in any activity that disrupts or interferes with the Service
• Attempt to reverse engineer, decompile, or extract the underlying AI models

4. AI-Generated Content

Regarding content generated through our Service:

• We do not claim ownership of content you upload. You must have the rights needed to upload and use that content.
• You may use generated output commercially, subject to applicable law and the terms of the providers used to create it.
• We reserve the right to use anonymized generated images for marketing and service improvement
• You are responsible for ensuring generated content complies with applicable laws
• We do not guarantee that generated output is exclusive, non-infringing, or eligible for intellectual-property protection
• AI-generated images may occasionally contain artifacts or imperfections

5. Payments and Credits

If you purchase credits:

• Credit packs are one-time, pay-as-you-go purchases in USD processed by Polar
• The Service does not currently sell subscriptions or renew credit packs automatically
• Starter and purchased credits do not expire
• Contact support@43frames.com to request help with a purchase. Eligibility for unused-credit refunds is reviewed case by case. Spent credits are not refundable unless required by law or charged for a failed operation.
• A refund processed through Polar removes the corresponding credit-pack amount from your 43frames balance
• We may change prices for future purchases. A price change does not alter credits already granted to your account.
• Under the referral program, an eligible new account receives 20 referral credits once, and the referring account receives 50 credits for each of its first 20 rewarded referrals.
• Self-referrals, duplicate accounts, established accounts, and automated or deceptive signups are not eligible for referral credits. Referral credits have no cash value and cannot be transferred between accounts.

6. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

7. Intellectual Property

The Service, including its software, algorithms, design, and content (excluding user-generated content), is owned by 43frames and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit permission.

8. Limitation of Liability

To the maximum extent permitted by law, 43frames shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless 43frames from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We reserve the right to terminate or suspend your account and access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
